Judge Adonyo Visits Disputed Kabale Land

On Tuesday (November 26, 2019) , Hon. Justice Dr Henry Peter Adonyo presided over a locus in quo at Nyakeine village, Nyakagagaba, Rwamucucu, Rukiga District formerly Kabale District.

The matter was filed at Kabale High Court vide Civil Suit No. 20/2013 by Mr Baryamureeba James.

The court viewed the land in dispute, which the plaintiff claims to have bought but is seeking to dispose of as well the land that he inherited from his late father and late mother.

The defendants contest that the said land was family land bought from the proceeds of the compensation received from the payments made because of the accidental death of their elder brother in an accident.

The contested land contains a farm of more than 20 acres, two houses and the graves of the plaintiff's mother and eldest son. The 1st defendant who is also the plaintiff's wife and the other defendants currently occupy the land. One of the two houses on the land belongs to the plaintiff while the defendants and the rest of the family occupy the other house.

At the locus in quo, additional testimonies from the Plaintiff, some of the defendants, the L.C I and LC II Chairpersons and some of the neighbors to the disputed land were got.

Present at visit were the Deputy Registrar, Kabale High Court, HW Didas Muhumuza, the Court Clerk/ Interpreter, Mr. Bruce Manzi, Ms. Philippa Bogere, the Research Officer, the Plaintiff; Mr. Baryamureeba James, the 1st Defendant Kabakonjo Abwoli, the 2nd Defendant Mr Roland Biryahwaho, the 3rd Defendant Nelson Bindeeba, the 4th Defendant Mr Peter Twongyeirwe, and the 6th Defendant Ms Patience Tumusiime. Also present was the Defendants' advocate Mr. Obed Mwebaza. Local area leaders including the LC1, and LCII were also present.

The court set 17th January 2020 as the date when judgement will be delivered.
